Acceptance of Terms By using the Platform, you confirm that you accept these Terms in full. If you do not agree with any part of these Terms, accessing or using the Platform or any Content is prohibited. If you are using the Platform on behalf of a business or organization, you guarantee that you have the authority to bind the entity to these Terms. Modifications to the Platform or Terms We reserve the right to revise these Terms at any time. Revisions will take effect once posted on this page. For registered users, we may notify you of substantial updates via email. Additionally, the Platform’s features and Content may change, expand, and/or be discontinued without prior notice. Regularly reviewing these Terms ensures you remain informed of any updates. Platform Availability The Platform and its Content are provided as-is and as-available. While we aim for uninterrupted service, we may temporarily, or permanently suspend or limit access to the Platform for business, legal, or operational reasons. Your Privacy and Data Use Your privacy is important to us. Please read our Privacy Policy to understand how your data is collected, processed, and/or shared when you interact with the Platform. Prohibited Conduct You must not: Engage in unlawful activities or use the Platform for illegal purposes. Attempt unauthorized access to the Platform, its systems, or related databases. Introduce harmful software, viruses, or malicious code. Exploit the Platform and/or its’ Content for commercial purposes without explicit permission. Impersonate others or misrepresent your identity. Use the Platform to generate unsolicited advertisements or spam. Scrape or automate data collection from the Platform. Reverse-engineer, disassemble, or otherwise attempt to obtain the Platform’s source code. Use the Platform if you are under the age of eighteen (18) Violations of these rules may result in the suspension of your access and/or legal ramifications. Termination Zentima may terminate or suspend your access or account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Creating and Managing Accounts While guests can browse certain areas of the Platform, specific features may require account registration ("Account"). Registration Requirements: Ensure all submitted information is accurate and up to date. Security: Safeguard your account credentials and notify us immediately if you suspect unauthorized use. Account Deletion: Use Delete account option when you login to your account profile Usage Rights and Intellectual Property You are granted a limited, non-exclusive, non-transferable and revocable right to access and use the Platform and its Content for personal purposes only. This includes the ability to download or print portions of the Content for personal reference. However, you must not: Modify any downloaded or printed materials. Use any part of the Content for commercial purposes without prior authorization. Separate images, videos, or graphics from accompanying text. All intellectual property rights, including copyrights and trademarks, remain the property of Zentima or its’ licensors. Any unauthorized use is strictly prohibited. User-Generated Content When you upload any content to the Platform, whole or in part of a property listing or otherwise, the following terms apply: Ownership and Licensing Any content you upload to the Platform is considered non-confidential and non-proprietary. Although you maintain ownership of the content you upload, by sharing it on the Platform, you grant Zentima a permanent, global, non-exclusive, royalty-free, and transferable right to use, store, modify, reproduce, share, display, and create derivative works from your content. This license allows Zentima to operate the Platform and promote its’ services. Your Responsibility You are fully accountable for the content you provide. It is your duty to ensure it complies with all relevant laws and does not infringe upon the rights of third parties, such as intellectual property or privacy rights. Platform’s Role and Limitations Zentima actively monitors user-uploaded content, including property listings. However, the accuracy, legality, and reliability of the content are solely the responsibility of the individual who provides it. Any agreements or transactions arising from content, such as purchasing a property, are strictly between the parties involved. Zentima assumes no liabilities in such dealings. Content Review and Removal Zentima reserves the right to review and, if necessary, remove any content uploaded to the Platform. This may occur without prior notification if we determine that the content breaches these Terms, violates laws, or infringes on the rights of others. Where appropriate, we may disclose your identity to parties asserting legal claims related to your uploaded content. No Guarantees for Uploaded Content Zentima does not guarantee that any content you upload will reach a specific audience, generate leads, or achieve desired outcomes. Performance depends on factors outside of Zentima’s control, and do not guarantee any level of success. By uploading content to the Platform, you agree to these Terms and acknowledge that Zentima’s role is limited to providing the platform for content sharing and does not include responsibility for its accuracy or compliance. Obligations and Requirements The Platform enables property owners ("Owners") and/or their sales representatives ("Agents") to list properties for sale (“Listings”), connecting them with potential buyers/investors ("Buyers"). Owners’ Obligations: must be legally permitted to advertise on the Platform. must act in lawful way on the Platform and in any interaction with other users. must act and ensure their listings are accurate, lawful, and compliant with local regulations. must not duplicate, copy or in any other manner replicate Listings. Agents’ Obligations: must be legally permitted to advertise on the Platform. must hold valid licenses from relevant authorities and authorization from property owners to advertise Listings. must act in lawful way on the Platform and in any interaction with other users. must ensure their Listings are accurate, lawful, and compliant with local regulations. must not duplicate, copy or in any other manner replicate Listings. Buyers’ Responsibilities: must be legally permitted to purchase the property(s) listed on the Platform must act in lawful way on the Platform and in any interaction with other users must verify Listings details also independently, as Zentima does not guarantee their accuracy or legality. Zentima as Real Estate Broker In addition to operating the Platform, Zentima, through Sevia s.r.o., may act as a real estate broker. Zentima may: Provide brokerage and intermediation services for partners (e.g., developers, property owners). Market and promote properties on behalf of partners. Facilitate communications and negotiations between buyers and partners. Earn brokerage fees or commissions from successful transactions. Limitations: Zentima does not guarantee completion of any transaction or profitability. Buyers remain responsible for conducting due diligence. Zentima is not liable for third-party misrepresentations but will take reasonable steps to ensure accuracy of partner-provided information. Brokerage services comply with Slovak law and EU regulations. By using the Platform, you acknowledge that Zentima may act both as operator and as a real estate broker. Investment Risks and Limited Liability of the Platform The use of the Platform is subject to the following limitations of liability, which are designed to clarify the responsibilities of Buyers in their engagement with the Platform: Buyers’ Responsibility Any decisions made by Buyers regarding the consideration, purchase, or operation of investment properties listed on the Platform are made solely at their discretion and responsibility. Zentima does not provide any legally binding advice or recommendations regarding investment properties. Buyers must rely on their own judgment and conduct due diligence before making any financial commitments. Investment Risks Buyers are expressly advised that purchasing investment properties involves inherent risks, as in any other type of investment. These risks include, but are not limited to, potential financial losses. The Platform does not guarantee that property investments will be profitable or free from financial risks. Accuracy and Authenticity of Listings While the Platform strives to identify fraud Content, Zentima does not warrant or guarantee that the property listings available on the Platform are genuine, accurate, or free from errors. Reference Use of Financial Projections Any financial projections, expected returns, or performance indicators included with property listings are provided solely for reference purposes. These projections are hypothetical and should not be interpreted as guarantees of future performance or outcomes. Buyers must understand that past or stated performance does not necessarily predict future results. Professional Consultation Recommended Buyers are strongly encouraged to seek advice and guidance from qualified professionals—such as financial advisors, real estate experts, or legal consultants—before making decisions related to investment properties. This is especially critical for individuals who lack sufficient knowledge, experience, or expertise in property investment. Disclaimer of Liability Zentima, its owners, partners, and affiliates explicitly disclaim all liability for any decisions, actions, or outcomes resulting from the use of the Platform or reliance on its Content. This includes, but is not limited to, financial losses, damages, inaccuracies, omissions, or other adverse outcomes. By using the Platform, you agree that Zentima is not responsible for any direct, indirect, incidental, or consequential losses or damages that may arise from your reliance on the Platform, its Content, or its Listings. By accessing and using the Platform, you acknowledge and agree to the above Limitations of Liability. These terms are designed to ensure that all users understand and accept their individual responsibility when engaging with investment opportunities presented on the Platform. User Interactions While the Platform facilitates communication between users, Zentima does not control these interactions. Users are responsible for conducting transactions safely and securing appropriate documentation for any agreements made. If you suspect fraudulent behavior, report it to the appropriate authorities. Paid Services The Platform may offer optional paid features ("Paid Services"), such as enhanced visibility for property listings. Fees for these services are non-refundable and do not guarantee specific outcomes. When acting as a broker, Zentima may charge brokerage fees or commissions in accordance with agreements with partners or applicable law. These are separate from any platform fees. Limitation of Liability Regardless of the damages you may experience, the total liability of Zentima, its owner, and any associated suppliers under these Terms is strictly limited to the amount you have actually paid through the Platform. If you have not made any purchases via the Platform, this liability is capped at EUR 100. This limitation serves as your sole and exclusive remedy under these Terms. To the fullest extent allowed by applicable law, Zentima, its owners, and its suppliers shall not be held responsible for any special, incidental, indirect, or consequential damages of any kind. This includes, but is not limited to, damages related to lost profits, loss of data, loss of other information, business interruptions, personal injuries, or loss of privacy. Such damages may arise from your use of, or inability to use, the Platform, any third-party software or hardware used in conjunction with the Platform, or any aspect connected to these Terms. This limitation applies even if Zentima, its owners, or its suppliers have been informed of the possibility of such damages and even in cases where the primary remedy fails to fulfill its essential purpose. Certain jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages. As a result, some of the limitations mentioned above may not apply to you. In such cases, liability will be restricted to the maximum extent permitted under applicable law. Disclaimer of Warranties The Platform is made available on an "AS IS" and "AS AVAILABLE" basis, without any guarantees, warranties, or assurances of any kind. It is provided with all faults and imperfections. To the fullest extent permitted by applicable law, Zentima, on its own behalf as well as on behalf of its owner, licensors, and service providers, explicitly disclaims all warranties—whether express, implied, statutory, or otherwise. This includes, but is not limited to, implied warranties of merchantability, fitness for a specific purpose, title, non-infringement, and any warranties that may arise from customary trade practices, course of dealings, or industry usage. Furthermore, Zentima does not warrant or guarantee that the Platform or its Content will fulfill your requirements, deliver intended results, function seamlessly with other software, applications, systems, or services, or operate continuously without disruptions. It also does not assure compliance with performance or reliability expectations or that any errors or technical defects be rectified. In addition, neither Zentima nor any of its providers makes any representations or warranties of any kind, express or implied, regarding: The operation, availability, or accessibility of the Platform, or the accuracy, completeness, or reliability of the materials, content, or information presented on it. The uninterrupted or error-free functioning of the Platform. The accuracy, reliability, or up-to-date nature of any information or content made available through the Platform. The safety and security of the Platform, its servers, or its Content, or that any emails sent on behalf of the Platform are free from harmful elements such as viruses, malware, trojans, worms, or other malicious components. Certain jurisdictions may not permit the exclusion of specific types of warranties or may limit the statutory rights of consumers. In such cases, the exclusions and limitations outlined in this section will apply to the greatest extent legally enforceable under applicable law.
